CONDITIONS OF LA SIRÈNE

1. SCOPE OF APPLICATION

These General Terms and Conditions ( hereinafter the "GTC") govern the purchase of dry cleaning services ( hereinafter the "Services") with collection and home delivery of clothing, ordered by a customer ( hereinafter the "Client") via this site www.lasirene.paris ( hereinafter the "Site").

These Services cover Paris intramuros, with the exception of the 12th, 13th, 18th, 19th and 20th arrondissements.

The Services are sold directly on the Site by the company READY TO CARE, a company organised under French law whose registered office is located at 2 place Skanderbeg 75019 Paris, France, under number 917 755 62 RCS Paris, under the trade name LA SIRENE, hereinafter "LA SIRENE".

By ordering or purchasing Services on the Site, the Client fully accepts the GTC . These GTC can be saved and/or printed and are accessible from all pages of the Site. LA SIRENE reserves the right to modify these GTC at any time. The applicable GTC are those in force at the date of the order by the Client.

2. Services

LA SIRENE offers eco-friendly dry-cleaning services for clothing to non-professional or professional Clients with possibility of collection and home delivery service.

3. PRICES

The prices applied are those displayed on the Site at the time of the order. Thus, in the event that the Client has created a customer account, the prices displayed in the "My account/My orders" section of the order summary page correspond to the prices paid by the Client for his previous orders.

As prices are subject to change, the Client must check the price in force at the time of the order, which is indicated when the Service is put in the basket. Prices are indicated in EUR and do not include the delivery costs of the order (hereinafter the "Delivery Costs"). These Delivery Costs are indicated to the Client on the shopping cart consultation page as well as on the summary page of the order, before the validation and payment of the latter

4. ORDER

4.1 Order Process

The Client is invited to select the Services chosen and put them in the shopping cart by clicking on the "Add to cart" button. The Client is invited to consult the summary of his order at any time by clicking on the "View Basket" button available at the top right of all pages of the Site.

At this stage, the Client can check the details of his order, identify any errors made in the data entry and correct them or delete one or more Services.

LA SIRENE cannot be held responsible for the inaccuracy of the information communicated by the Client. The Client account will give access to a personal space where Clients can track their orders and access invoices.

To finalize his order, the Client :

  • shall confirm his collection/delivery and billing address,
  • shall choose a date and time of withdrawal and return delivery,
  • shall read and accept the GTC explicitly by ticking the box "I have read and accept the general conditions of sale" before proceeding to the payment of his order,
  • Is then invited to pay the amount of his order trough a secure payment plateform by clicking on the button "Proceed to payment".

The sale is deemed complete only after confirmation by e-mail by LA SIRENE that the order is accepted, , the Client formally accepting the use of e-mail for such confirmation.

LA SIRENE reserves the right to refuse the order if it reveals to be abnormal, abusive, or contrary to the provisions of the GTC. LA SIRENE will not be held responsible if the administrative and/or technical processing of an order on the Site is disrupted by a virus, computer bug, unauthorized human intervention or any other cause beyond the control of LA SIRENE or if there is a strong presumption of fraud, or that fraud has occurred in any form whatsoever, in particular by computer, LA SIRENE reserves the right in this case to interrupt or cancel the order in progress. In such cases, the Client will be informed by e-mail of the cancellation of his order and LA SIRENE will reimbursed the sums that the Client will have paid, if any prior to the cancellation of his order by LA SIRENE.

4.2 Availability of Services

The Services offered are subject to availability. Information on the availability of the Services is provided at the time of placing the order, on the Services page.

4.3 Cancellation of the Order

Once the payment has been made, the Client cannot modify or cancel his order. However, if the order has not yet been executed by LA SIRENE, the Client may in certain conditions cancel his order by contacting Client Service at the following number 07 72 37 12 31 under the conditions defined in Article 7 below.

5. Payment

The Services will be paid in Euros. The Client will also have to pay the duties and taxes attached to the sale as well as any bank charges wich will always be chargeable to him.

Payment for the order will be made by credit card (Visa, Mastercard and American Express are accepted).

LA SIRENE has set up a secure payment system for any order placed on the Site. Payments are made on an external platform through a payment provider – ADYEN – that complies with PCI DSS security standards. The payment will be considered validated after confirmation of the payment agreement made by the issuing body. In case of refusal of the bank, the order will be automatically refused and LA SIRENE will then be relieved of any obligation and responsibility towards the Client.

The Client has the possibility to download his invoice from his customer account in the "My orders" section.

6. pick-up AND DELIVERY

6.1 Terms of pick-up and delivery

The Services are accessible only in Paris intramuros, with the exception of the 12th, 13th, 18th, 19th and 20th arrondissements.

If the pick-up/delivery address is validated by LA SIRENE, the Client will have a pick-up and delivery at the indicated address.

No pick-up or delivery will be made by LA SIRENE if payment has not been received in full.

The Client shall bear the consequences (impossibility of delivery, additional transport costs, etc.) resulting from any incorrect and/or incomplete delivery indications/information he provided , or resulting from his absence at the agreed date and time of pick-up or delivery. LA SIRENE will do its best efforts to respect the processing times chosen by the Client when ordering.

6.2 Pick-up and receipt of Client's Articles

The risks attached to the clothing picked up from the Client (hereinafter the "Articles"), are transferred to LA SIRENE from their pick-up until their return to the Client.

These risks are transferred back to the Client upon delivery, i.e., at the time the Client (or any third party designated by him) regains physical possession of the Articles picked up and processed by LA SIRENE.

The Client is invited to express any reservations or useful comments concerning any problem or quality on his Articles before its cleaning by LA SIRENE:

  • On the Site in the summary part of the order by leaving a comment,
  • or in the "comment" part of the "Delivery Note" which will be submitted to him by the carrier and which the Client shall sign at the time of pick-up of his Article.

Once the Articles have been picked up at the Client's home, the operators of LA SIRENE will examine the Articles and send by e-mail any comments on the condition of the Articles and their diagnoses if necessary. The operators of LA SIRENE also take upon receipt a photograph attesting the condition of the Articles picked up.

Upon delivery of his Articles to the Client once cleaned, the Client is invited to examine and check his Articles in the presence of the carrier. Any loss or damage is to be reported immediately to the carrier and customer service at the following number 07 72 37 12 31.

7. EXCLUSION OF THE RIGHT OF WITHDRAWAL

By proceeding to the payment of his order and accepting these GTC, the Client gives his irrevocable agreement to the beginning of performance of the Services and therefore waives his right of withdrawal.

As an exception to the foregoing, in accordance with the terms of article 4.3, if the Client wishes to cancel his order, he can contact the customer Service at the following number 07 72 37 12 31. The customer Service will indicate whether this cancellation is possible or not depending on the beginning of execution or not of said order, in particular according to the orders placed with the carriers. If cancellation is possible, the Client will be reimbursed for the costs incurred by him. LA SIRENE cannot be held responsible in the event of refusal to cancel an order.

8. Limitation de responsabilité

LA SIRENE cannot be held liable for the breach of one of its obligations if the poor performance of the "contract" with the Client is the result of an event of force majeure, or the result of the Client’s act or omission or of an unforeseeable and insurmountable act of a or third party or an obstacle outside of LA SIRENE’s control that LA SIRENE could not reasonably foresee and whose consequences cannot reasonably be avoided or overcome by LA SIRENE.

On the Site, at the time of the order or during the collection of the Client's Articles, the Client is invited to make known on the Delivery Note as decribed in Article 6.2 of the GTC all the circumstances and specificities that are likely to affect the result of the cleaning of his Articles (such as a prior treatment/cleaning) or that are likely to cause a degradation of his Articles or which are likely to cause a snag under the effect of cleaning.

LA SIRENE reserves the right:

  • To refuse to treat certain Articles if they are considered too deteriorated or too fragile. In such case the Client will be notified immediately by the operators of LA SIRENE and will be refunded any sum committed, the Client’s Articles will be returned to him as soon as possible.
  • To make warnings in writing (sms / WhatsApp and e-mail) on certain Articles in case of identification of untreatable stains or odors, risks of deterioration or damage that could result from the treatment of the Articles. In such case, if despite these warnings, the Client wishes to proceed with the cleaning of his Articles, LA SIRENE cannot be held liable for any damage resulting from the cleaning and processing and no compensation will be possible.

Upon delivery of his Articles to the Client once cleaned, the Client is invited to examine and check his Articles in the presence of the carrier. Any loss or damage is to be reported immediately to the carrier and customer service at the following number 07 72 37 12 31.

No action may be taken against LA SIRENE if the Client has not immediately reported the loss or deterioration of his Articles in the presence of the carrier following his home delivery.

LA SIRENE undertakes to provide all the care in use in the profession for the implementation of the Services offered. Notwithstanding the above, LA SIRENE is bound by an obligation of means. LA SIRENE cannot therefore be held liable in the event of :

  • deterioration due to improper cleaning that could not have been detected during a professional examination of the Article, in particular in the event of damage caused by a hidden defect in the Article,
  • the absence or erasure of composition labels and care labelling,
  • Articles that have undergone special treatments not reported at the deposit.

In general, LA SIRENE cannot be held liable for the breach of one of its obligations if the improper performance of the Services results from a case of force majeure, the fact or omission of the Client, the unforeseeable and insurmountable fact of a third party or an obstacle beyond the control of LA SIRENE, which LA SIRENE could not reasonably foresee and whose consequences cannot reasonably be avoided or overcome by LA SIRENE.

In the event of damage to an Article due to LA SIRENE not responding to the aforementioned cases, any compensation or refund will be made on presentation of the invoice related to purchase of the Article and according to the scale below (which can also be consulted on the Site).

The following adjustments shall be applied to the above-mentioned scale in accordance with the age of the Article.

  • 80% for an Article purchased less than 3 months ago;
  • 60% for an Article purchased less than 30 months ago;
  • 30% for older Articles.

For a very used Article, LA SIRENE may issue written warnings by email / SMS / WhatsApp.

In the event of a damaged Article, only the Articles entrusted to LA SIRENE may be compensated. In the case of an ensemble, only the damaged piece(s) will be compensated.

In the event of loss of the Article, LA SIRENE takes responsibility unless LA SIRENE provides proof that no fault was committed, and that this loss is due to a foreign cause that LA SIRENE could not foresee.

9. INTELLECTUAL PROPERTY

The Client may not, at any time, use all or part of the name LA SIRENE and/or registered trademarks and/or models of LA SIRENE for commercial, advertising, promotional or other purposes. Any act of infringement, counterfeiting or complicity will be subject to prosecution.

10. PERSONAL DATA

LA SIRENE invites the Client to consult its Privacy Policy by clicking on the following link "Data Protection Policy of LA SIRENE" for more information on how LA SIRENE processes personal data and the Client's rights in relation thereto.

11. APPLICABLE LAW AND DISPUTES

These GTC as well as any order placed via the Site are governed by the French law , to the exclusion of its provisions which would refer to the imperative application of a foreign law.

In the event of a dispute concerning these GTC and/or an order, LA SIRENE invites the Client to contact LA SIRENE Customer Service on +33 7 72 37 12 31 in order to refer his claim and try to find an amicable solution with LA SIRENE.

failing an amicable agreement with LA SIRENE's Customer Service, the Client may submit the dispute to the consumer mediator or the European Commission via its online dispute resolution platform available at the following link :

https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home.chooseLanguage, in accordance with Directive 2013/11 of the European Parliament and of the Council of 21 May 2013 on alternative dispute resolution for consumer disputes and Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes. Regardless of the method used to submit the dispute to the mediator, for the referral to a mediator to be admissible, it must include: postal address, e-mail address and telephone number, a brief summary of the facts and evidence of the measures already taken with the SIRENE Customer Service.

Disputes cannot be examinated by a mediator if : the request is manifestly unfounded or abusive, or if the request has been previously examined or are being examined by another mediator or by a court, or if the Client has submitted his request to the mediator within a period of more than one year from his written complaint to LA SIRENE or if the dispute does not fall within the scope of the competence of the mediator, or if finally the consumer does not justify having attempted, beforehand, to resolve his dispute directly with LA SIRENE by a written complaint.

Notwithstanding the foregoing, if no amicable solution is found (including following the mediation process described above) or if the Client wishes to bring the claim or dispute directly before a court without following an amicable resolution process, the French courts will be territorially competent to hear any dispute, unless otherwise legal provisions would refer to the mandatory jurisdiction of a foreign court
